A bill on amendments to certain legislative acts (in terms of clarifying identification and authentication procedures), which introduces the concept of a digital profile of a citizen and a legal entity, was published on Monday for public comment.
We will remind that earlier the Ministry of Telecom and Mass Communications has already published a notice on the beginning of the development of the draft law, the main task of which is “to establish the rules and basic approaches to the regulation of issues of remote identification and authentication of persons, which is of a legally significant nature and unambiguously generates legal consequences, if legal relations develop in the spheres, not related to the provision of public services and the implementation of public functions”. The term of entry into force of the document, according to the plan of the Ministry of Telecom and Mass Communications - July 2019.
The new document has been posted regardless of the previous one; the expected date of entry into force has not been indicated.
The new document proposes to provide the following definitions:
- identifier is a unique designation of information about a person, which is necessary to identify such a person by using technical and (or) technological methods;
- identification, face authentication - a set of measures to establish identifiers and (or) information about a person, to compare this information with an identifier or to verify this information, as well as to check a person for belonging to a person of an identifier (identifiers) by comparing the identifier (identifiers) with the available information about the person, and establishing the validity of the person's use of the identifier (identifiers) carried out in accordance with this Federal Law, other federal laws adopted in accordance with them by regulatory legal acts or by agreement of the parties, as a result of which the person is considered established."
It is proposed to introduce an article with the following content into the law “On information, information technologies and information protection”:
Digital profile
1. A digital profile is a collection of information about citizens and legal entities contained in the information systems of state bodies and organizations exercising certain public powers in accordance with federal laws, as well as in a unified identification and authentication system.
The infrastructure of a digital profile is a set of information systems in a single identification and authentication system that provide access to a digital profile.

2. The digital profile infrastructure is created for the exchange of information in electronic form between individuals, organizations, state bodies, local governments.
3. With the help of the digital profile infrastructure, inter alia, it is provided:
1) identification and authentication of individuals and legal entities;
2) access to the digital profile and the provision of information included in the digital profile in electronic form to individuals and legal entities;
3) provision and updating, at the request of state bodies, local self-government bodies, organizations exercising certain public powers in accordance with federal laws, and other organizations, of information about an individual or legal entity contained in a digital profile, including information contained in state information systems, information systems of organizations exercising certain public powers in accordance with federal laws;
4) obtaining and revoking consent to the processing of personal data of citizens and information about legal entities in cases involving the receipt of information about a citizen or legal entity using the digital profile infrastructure;
5) providing information for the formation of requests for state and municipal services or the performance of state and municipal functions;
6) storage of information about citizens and legal entities, including the results of the provision of state and municipal services in electronic form, in the manner established by the Government of the Russian Federation.
The bill also spells out the procedure for identifying and authenticating a person.
